Terms of Service
Welcome to fountainelectric.com (the “Site”), owned and operated by Fountain Services, LLC, doing business as Fountain Electric & Services (“Fountain,” “we,” “us,” or “our”), located at 244 Callahan Koon Rd., Spindale, NC 28160. These Terms of Service (“Terms”) govern your access to and use of the Site, our services, and any communications, including SMS text messages, that you receive from us. By accessing the Site, requesting a quote, booking service, applying for employment, or opting in to receive communications from us, you agree to these Terms.
If you do not agree to these Terms, please do not use the Site or our services.
1. Who We Are
Fountain Services, LLC is a third-generation, family-owned company operating across multiple service divisions, including Fountain Electric & Services, Fountain Heating & Air, Fountain Plumbing Services, Fountain Building Services, Fountain Auto Tech, and The Fountain Collection. These Terms apply to fountainelectric.com and, unless a division-specific site states otherwise, to communications sent on behalf of any Fountain division.
2. Use of the Site
You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Site in any way that violates applicable federal, state, or local law
- Attempt to gain unauthorized access to any portion of the Site, our systems, or related networks
- Interfere with or disrupt the Site or servers or networks connected to the Site
- Use automated means, including bots or scrapers, to access the Site without our prior written permission
- Submit false, misleading, or fraudulent information through any form on the Site
We reserve the right to restrict or terminate your access to the Site at our discretion, without notice, for conduct that we believe violates these Terms or is harmful to Fountain, our customers, or other users.
3. Requesting Service and Quotes
Submitting a request for a quote, estimate, or service through the Site does not guarantee that Fountain will be able to perform the requested work. All service is subject to scheduling availability, service area, and a final agreement between you and Fountain. Pricing displayed on the Site, if any, is for general informational purposes and is not a binding quote.
4. Employment and Career Applications
If you submit an application through our careers pages (including jobs.fountainelectric.com), you represent that the information you provide is accurate and complete. Submitting an application does not guarantee an interview, offer, or employment. We may share application information internally across Fountain divisions and with our applicant tracking system provider for the purpose of evaluating your application.
5. Communications and SMS Terms and Conditions
By providing your phone number and opting in, you agree to receive text messages (SMS) from Fountain related to your application status, service requests, appointment updates, promotions, or general account communications, depending on the program you opted into.
5.1 Consent. When you opt in to a Fountain SMS program, we may send you text messages to notify you of updates and to engage in discussion relevant to that program (for example, your application status or service appointment).
5.2 Opting Out. You can cancel SMS service at any time. Just text “STOP” to unsubscribe. After you send “STOP,” we will send you a confirmation text that you have been unsubscribed, after which you will no longer receive messages from that program. If you want to opt in again, reply “START” to the number you unsubscribed from.
5.3 Help. If you are experiencing issues with a messaging program, reply with the keyword “HELP” for assistance, or contact us directly at marketing@fountainelectric.com.
5.4 Carrier Liability. Carriers are not liable for delayed or undelivered messages.
5.5 Message and Data Rates. Message and data rates may apply to any messages sent to you from us or from you to us. Message frequency may vary. If you have questions about your text or data plan, please contact your wireless provider.
5.6 No Sharing of Opt-In Data. Text messaging originator opt-in data and consent will not be shared with any third parties for marketing or promotional purposes.

6. Intellectual Property
All content on the Site, including text, graphics, logos, images, and software, is the property of Fountain Services, LLC or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.
7. Third-Party Links and Services
The Site may contain links to third-party websites or services that are not owned or controlled by Fountain, including social media platforms, review sites, financing partners, and applicant tracking systems. We are not responsible for the content, privacy practices, or terms of any third-party site. Your use of third-party sites is at your own risk and subject to their respective terms.
8. Disclaimer of Warranties
The Site and its content are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Fountain does not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
9. Limitation of Liability
To the fullest extent permitted by law, Fountain Services, LLC and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or our services, even if we have been advised of the possibility of such damages.
10. Indemnification
You agree to indemnify and hold harmless Fountain Services, LLC, its divisions, officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.
11. Changes to These Terms
We may update these Terms from time to time. The “Effective Date” at the top of this page reflects the most recent revision. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law principles. Any disputes arising under these Terms will be resolved in the state or federal courts located in Rutherford County, North Carolina.
